Donald Paul Day is a partner at Berry, Day & McFee.

Mr. Day received his Bachelors Degree from the University of Florida in 1983 and his law degree from Nova University in 1986.

He was formerly a prosecutor with both the Broward and Collier County State Attorney's Offices before going into private practice. His practice is currently limited to criminal defense work in Federal and State courts throughout Florida.

He is admitted to practice in all Florida courts, the Federal Middle District Court, the Eleventh Circuit Court of Appeals and the United States Supreme Court.

He is a member of the Florida Bar Criminal Law Section, the National Association of Criminal Defense Lawyers, the Florida Association of Criminal Defense Lawyers, and the Collier County Association of Criminal Defense Lawyers (Treasurer 1993-94).

He is also a founding member of the National DUI College at Harvard University. Mr. Day has lectured and authored throughout Florida and the United States on the subject of Field Sobriety Tests in DUI cases.

He was one of the first attorneys in the State of Florida to exclude successfully the use of field sobriety tests in DUI cases. As a prosecutor and as a defense attorney, Mr. Day has handled over 2,500 DUI cases.
